Terms & Conditions

1. Agreement to Terms

By accessing or using Kito AI Assistant ("Kito", "we", "our", "us"), you agree to be bound by these Terms & Conditions. If you disagree with any part of these terms, you may not access or use our services.

These terms apply to all users, including free and paid subscribers, of Kito AI Assistant located at https://kito.chat and all associated subdomains and services.

2. Eligibility & Account Registration

To use Kito, you must:

  • Be at least 13 years old (or the age of digital consent in your jurisdiction)
  • Provide accurate, complete, and current registration information
  • Maintain the security and confidentiality of your account credentials
  • Accept full responsibility for all activities that occur under your account
  • Notify us immediately of any unauthorized account access

You are responsible for maintaining the confidentiality of your password and for all activities that occur under your account. Kito reserves the right to refuse service, terminate accounts, or remove content at our sole discretion.

3. Subscription Plans & Payments

3.1 Available Plans

Kito offers the following subscription tiers:

  • Free Plan: Limited to 50 queries per day, 500 queries per month, chat history retention of 30 days
  • Starter Plan ($19/month): 10,000 queries per day, priority response speed, unlimited chat history, export features
  • Agency Plan ($49/month): 100,000 queries per day, fastest response speed, team access (up to 5 users), priority support
  • Enterprise Plan (Custom Pricing): Unlimited queries, dedicated AI instance, custom API integration, white-label options

3.2 Payment Terms

All subscription fees are billed in advance on a monthly basis. Payments are processed securely through our third-party payment processors. By subscribing to a paid plan, you authorize us to charge your selected payment method on a recurring monthly basis until you cancel your subscription.

⚠️ NO REFUND POLICY

ALL SALES ARE FINAL. NO REFUNDS WILL BE ISSUED FOR ANY REASON, INCLUDING BUT NOT LIMITED TO:

  • Partial use of subscription period
  • Change of mind or dissatisfaction with service
  • Technical issues (we will work to resolve issues but no refunds)
  • Account termination by user or by Kito for policy violations
  • Failure to use the service during the subscription period

By purchasing any paid plan, you explicitly acknowledge and agree to this no-refund policy.

3.3 Failed Payments

💳 Failed Payment Policy

In the event of a failed payment (e.g., insufficient funds, expired card, bank decline):

  • The charged amount will be automatically refunded/transferred back to the original payment method within 3-5 business days.
  • Your subscription will be paused until a successful payment is processed.
  • You will receive notification of the failed payment via email.
  • You have 7 days to update your payment method before your account is downgraded to the Free Plan.
  • Kito is not responsible for any bank fees, overdraft charges, or currency conversion fees resulting from failed payment attempts.

3.4 Subscription Cancellation

You may cancel your paid subscription at any time through your account settings. Cancellation will take effect at the end of your current billing period. No refunds or prorated credits will be provided for partial months. Upon cancellation, your account will be downgraded to the Free Plan, and you will lose access to paid features.

3.5 Price Changes

We reserve the right to change subscription prices at any time. Price changes will be effective at the start of your next billing cycle following at least 14 days' notice via email. Continued use of the service after price changes constitutes acceptance of the new pricing.

4. Acceptable Use Policy

You agree NOT to use Kito for:

  • Illegal activities or violations of any applicable laws
  • Generating harmful, abusive, harassing, threatening, or discriminatory content
  • Attempting to reverse engineer, extract the underlying AI model, or bypass rate limits
  • Automated bot usage, excessive API calls, or any activity that disrupts service for other users
  • Sharing explicit, violent, or otherwise inappropriate content
  • Medical, legal, or financial advice without professional consultation
  • Any purpose that violates third-party rights, including intellectual property

Violation of these terms may result in immediate account termination without refund.

5. AI Service Disclaimer

Kito is an AI assistant and may produce inaccurate, incomplete, or inappropriate responses. You acknowledge that:

  • AI responses are generated based on patterns and may contain errors
  • Kito does not provide professional advice (legal, medical, financial, etc.)
  • You are solely responsible for verifying any information before acting upon it
  • Kito is not liable for any damages resulting from reliance on AI-generated content
  • We reserve the right to monitor, review, and retain conversations for quality improvement and safety

6. Intellectual Property

  • Kito's Software: All code, designs, trademarks, and branding are owned exclusively by Kito.
  • Your Content: You retain ownership of your conversation inputs. By using Kito, you grant us a license to process, store, and use your content to provide and improve our services.
  • AI-Generated Outputs: Outputs generated by Kito are provided for your use, but we do not claim ownership. However, we cannot guarantee that outputs are unique or free from third-party intellectual property claims.
  • Prohibited Use: You may not copy, reproduce, distribute, or create derivative works of Kito's software or branding without explicit written permission.

7. Service Availability & Modifications

  • We strive for 99.9% uptime but do not guarantee uninterrupted service
  • Scheduled maintenance will be announced when possible
  • We reserve the right to modify, suspend, or discontinue any feature at any time
  • Rate limits may be adjusted to ensure fair usage across all users
  • Emergency maintenance may occur without prior notice

8. Limitation of Liability

To the maximum extent permitted by law, Kito and its founders, employees, and affiliates shall not be liable for:

  • Any indirect, incidental, special, consequential, or punitive damages
  • Loss of profits, revenue, data, or business opportunities
  • Damages resulting from service interruptions, data loss, or AI-generated errors
  • Third-party claims arising from your use of Kito

Our total liability, regardless of the cause of action, shall not exceed the amount you paid us in the 12 months preceding the claim (or $50 for free users).

9. Indemnification

You agree to indemnify, defend, and hold harmless Kito and all employees from any claims, damages, losses, liabilities, costs, and expenses (including legal fees) arising from:

  • Your violation of these Terms & Conditions
  • Your use of Kito AI Assistant
  • Your violation of any third-party rights
  • Any content you submit or generate through Kito

10. Termination

We may terminate or suspend your account immediately, without prior notice or liability, for any reason, including:

  • Violation of these Terms & Conditions
  • Abuse of the service or excessive usage beyond reasonable limits
  • Illegal or fraudulent activity
  • Non-payment of subscription fees (for paid plans)

Upon termination, your right to use Kito will immediately cease. No refunds will be provided for any unused subscription time.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions. Any disputes arising under these terms shall be subject to the exclusive jurisdiction of the courts located in your jurisdiction of residence.

12. Changes to Terms

We reserve the right to modify these Terms & Conditions at any time. Changes become effective immediately upon posting. Material changes will be notified via:

  • Email notification to registered users (14 days advance notice for material changes)
  • In-app notification upon login
  • Updated "Last Updated" date at the top of this page

Your continued use of Kito after changes constitutes acceptance of the modified terms.

⚠️ IMPORTANT ACKNOWLEDGMENT

By using Kito AI Assistant, you acknowledge that you have read, understood, and agree to be bound by these Terms & Conditions, including the NO REFUND POLICY for all paid subscriptions. You also acknowledge that failed payments will be automatically refunded to the original payment method, but no refunds will be issued for any other reason once a payment is successfully processed.
